WHAT DO WE DO WITH YOUR INFORMATION?
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.
When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.
We may share your data within the Clare V. company. We may also share it with others who help us serve you. Because we work with Shopify, we will share your data with Shopify and some supporting companies to help us process data, host our digital channels, process payments, send communications, fulfill orders, or provide us or you with services while shopping with us. These companies are required by law to protect your data and cannot use your data with the exception of helping us provide you with products and services or as allowed by the privacy law and our contracts.
Shopify Inc. uses a combination of data centers and cloud service providers to store your personal data in the United States and Canada. When personal data is transferred to the United States, it is either done so through the EU-U.S. and Swiss-U.S. Privacy Shield, for Shopify’s own storage, or through contractual data protection addenda (DPAs) with third-party service providers. The EU-U.S. and Swiss-U.S. Privacy Shields are also considered adequate under the GDPR. Shopify’s Privacy Shield certification statement can be found on PrivacyShield.gov.
HOW WE GET YOUR CONSENT
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. For our Find In-Store module, we use your IP address based on your browser permissions to do so.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent via a checkbox to opt into our marketing list, which you can uncheck if you wish to opt out.
AGE OF CONSENT
By using this site and/or by accepting our policies, you represent that you are above the age of 16. If you are below the age of 16, then a parent or legal guardian must consent on your behalf. If we learn that we have collection any data for someone aged under 16, then we will delete it.
WITHDRAW CONSENT
If after you opt-in, you change your mind, you may withdraw your consent for us to contact you at any time by unsubscribing to communications at the footer of our website, and you may withdraw consent for the continued collection, use or disclosure of your information, by visiting the Opt Out page.

SHOPIFY
Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.
PAYMENT
If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SHOP PAY INSTALLMENTS PRIVACY AND DATA SECURITY
Affirm will service the installments loans for customers who pay using Shop Pay Installments.
Affirm will send notifications to these customers related to their post-purchase payments.

CHAT WIDGET
If you use our chat widget, Gorgias is the third party service that enables this feature. These chats are saved within Gorgias, but never shared or sold.
THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.
If you use our Find In-Store module, IPStack is the third party service that sorts our retail locations by distance from your IP address.
We do share customer information with third party marketing partners for commercial purposes, but only for customers who have opted into receiving communication from us. We also receive data from third parties, such as Oracle, in order to share information out to our customers, such as our seasonal catalog.
However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.
For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.
In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.
Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.
SHOPIFY DISCLOSURES TO THIRD PARTIES

PROTECTING YOUR DATA
Shopify is our data processing partner. To protect your personal information, Shopify takes reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.
If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. To keep your data safe, we ask you to pick a password when you create an account. You should avoid using the same password across sites or sharing your password information with anyone. Doing so makes your data vulnerable, and it’s very hard for us to protect you from another person’s breach.
Also, please note that Clare V. will never ask for your password, so if you receive anything suspicious from someone pretending to be us, don’t give them your information.
COOKIES
‘Cookies’ are small text files stored on your computer when you visit certain web pages. We use these important pieces of information to remember who you are when you come back and visit, keep track of what you have in your basket and tailor our website exactly to your needs.
Cookies do not store personally identifiable information such as name, address or payment details, but they do provide us with encrypted information to help improve your experience of the site. For example, they help us identify errors, suggest related products you may like when browsing and allow you to connect with social media sites such as Facebook, Twitter and Pinterest. We do use other "third party" cookies who may also set cookies during your visit to be used for retargeting purposes. Opt-Out Preference Signals. Your browser settings may allow you to automatically transmit the Global Privacy Control (GPC) signal to online services you visit. When we detect such signal, we place a U.S. Privacy String setting in your browser so that any third party who respects that signal will not track your activity on our website. Right to Correct
You have the right to correct inaccuracies in your personal data, taking into account the nature of the data and our purposes for processing it.
Request Verification
Before we can respond to a Request to Know or Request to Delete, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft. Requests to Opt-Out do not require verification.
Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request.
For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.
In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:
- If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
- If the only data we have collected about a consumer is gathered through website cookies (i.e. the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.
Authorized Agent
A California resident's authorized agent may submit a Request to Know or a Request to Delete under the CCPA by emailing us at moc.veralc@ycavirp. Requests submitted by an authorized agent will still require verification of the person who is the subject of the request in accordance with the process described above. We will also ask for proof that the person who is the subject of the request authorized an agent to submit a privacy request on their behalf. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 must submit proof of statutory power of attorney, but consumer verification is not required.

Notice of Financial Incentive
Users who sign up for our marketing emails receive a 15% discount on their first purchase. Users who sign up for our marketing text messages receive a 15% discount on their first purchase. Users who sign up for our birthday email receive a 15% discount on one transaction during their birthday month. A user provides their email address, birthday, and/or text number and consents to receive emails and/or text messages in exchange for a discount(s) provided via coupon code(s). To opt-in to marketing messages a user must enter and submit their email address and/or text number into the forms located at the footer of our website. To opt-in to birthday emails a user must fill in their birthday on an email form sent to them after entering and submitting their email address for email marketing. A user may unsubscribe from our marketing emails and birthday emails by using the unsubscribe link in the email footer at any time. A user may unsubscribe from our marketing text messages by replying STOP to the text message at any time. We calculate the value of the offer and financial incentive by using the expense related to the offer.

- We will not provide a different level or quality of goods or services to you
However, we may offer a different price, rate, level, quality, or selection of products or services if your personal data is required in order to provide those products or services and you have exercised your right to opt out, or the offer is related to a voluntary loyalty or rewards program.

You have the right to opt-out of any selling of your personal data, processing of your personal data for purposes of targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects for you.
